Is something i love,
I have been dealing with a particular reborn supplier faithfully for four years
who when RBUK first started ~ she was the only dealer on here and made a fair amount of money
from it...
I ordered some beating hearts from her
they were posted ~ tracked
the tracking number clearly says they havent been delivered
and she wont refund me :roll:
She is saying this......


Cath as i explained it is with Royal mail and being investigated by them as to why parcels I have posted to your address dont seem to turn up...I am not the only seller who has posted to your address and you have informed us the parcels have not been delivered to you so we need to be patient and let fraud squad team investigate and once i get a reply and their investigation is complete then we can sort the problem out...This is the 4th or 5th package I have posted that has not apparently been delivered even though i have proof of postage..but dont worry Cath I will investigate and i am checking with other suppliers if they have experienced same problem with parcels not being delivered....we are compiling an address alert amongst us..please be patient while this matter is being dealt with.......

A/ it is the third item that hasnt arrived ~ not the sixth
B/ i have no idea who these 'other suppliers' are ~ lol im bloody blacklisted
and the tracking says it hasnt arrived :evil: :angry: :angry:
She wont refund me as apparently there is a fraud squad investigating ~
Well they would wouldnt they ~ lets be honest ~ i must be good to obtain the parcel but manage to keep
the tracking as not arrived :roll: :roll: :twisted: :angry: :angry: :angry: :angry:

Blimey! Well if she has dealt with you for such a long time, she would know that you don't lie about it and as you said with the tracking number that has been provided, anyone can see that the package hasn't been delivered, but you are right to ask for a refund. Was the recent package sent via first class recorded?
You could always go to your local post office with the tracking number and tell them that you expected it sooner and yet it gives no details of where it is when you check with that number. I did that once before and they told me roughly how long I should wait until they could do something.
And I may be stupid, but even I know that the "fraud Squad" as she says, can't do anything unless the signature your end wasn't done by you but they were signing your name! Yes, Royal Mail deal with it, but they can't do that themselves.
Has SHE made a mistake with the address?

Ok Cathy, so am I to believe you are a liar and a thief and a repeated one at that. What the hell is that woman on. Has she ran any of what she has said past her brain.
Does she not know this is deformation of character and slander. Before she accuses you of anything she needs proof that the parcel was delivered and signed for. Tracking states non delivery. Had someone at your address signed for the package it would have came up," delivered " in their records. They have no signature because the package never reached its destination.
I would inform this woman of your rights as a customer. Your contract is with her. If she sends the package via courier, Royal Mail or whatever, she has made a contract with them. It is down to her to take action and open a case against the courier for non delivery of goods. She must refund your money, she has no right to it. She is breaking the law.
I would tell her you are going to report her to the Trading Stander's Officer. Also that you are taking legal advice.

Almost everyone has a help line 24/7 to legal advice with their House Insurance policy. Give them a call, then give her a fright....with regards to her saying the Fraud Squad are investigating the matter...She is watching too many American Movies where they all live in Cucukoo Land.

i am soooo annoyed ~ i have been more than fair
and to begin with when i messaged her she kept
saying give it a bit more time ~ this went on and on and on
as i ordered 14th feb ~ raised a email to say things had not arrived
beginning march ~ and have spent over a month with her saying
i wont refund we have to give it more time
now its past 45 days and paypal wont do anything....
kipper and stitched springs to mind :oops: :roll: :roll:

Cathy,

Have you tried consumer direct to? Trading Standards should be contacted to.

Also, say to her you have been on to Royal mail Yourself and that it is down to the sender to claim compensation for missing parcel/package.
Royal mail do not deal with the person who is to receive it they will only deal with person who sent it. The fraud squad at royal mail will not get involved unless, it has been signed for and that person is not at your address.
If it has not been signed for then it is missing.
Proof of Postage is not Proof of Delivery.
I would state a few rules and regulations to her.

You have paid for goods and a service that you have not received, therefore she is technically breaking the law.
She has had your money and you have received nothing in return.

I would email her and say that unless you receive your money back within 48/72 hours then you will have no other option but to take it to the relevant authorities, which could result in her company being investigated in every little detail. Also state that you have also sort legal advice and if the matter has to go further then it could result in her having to pay back the money not only for the goods that have gone missing, but also legal costs etc., Also it has been noted that she has held off giving a refund until the time limit for giving refund has expired. All emails have also been printed off ones sent and ones received as these will be used as evidence if the need arises.
State that you do not want to take this course of action, but time has dragged on and it has not been sorted out.

You could also add, that you have ordered off her many times and that while many items get through the odd one does occassionally go missing which is down to the Royal Mail.
That you do not complain etc., unless you have to and this occassion you have been more than patient.

I think you should keep on at her Cathy.

Go onto Consumer Direct Website and look under internet buying.

If I have read it right,
You can get a refund if items arent delivered within 30 days of placing an order.

Try there.

If this person is who I think she is, she should hang her head in shame. She built her business on your back.

Please call who ever it is your home insurance deal with. IT IS FREE ADVICE being as you have already paid a premium for it. They will tell you all of your legal rights. IT IS ALWAYS BETTER TO TALK TO SOMEONE

Tell her you will take her to the SMALL CLAIMS COURT

oopsie you could still try a claim at paypal notifying them of delaying emails & that she was chasing the post office. i think they may think this reasonable. & refund. As for the post office looking into a fraud scenario, i think not! best thing to do is spread the word on her poor service by naming & shaming.

oh cath :( thats a toughie! surely if they are tracked and that shows up shed be insured??

:( i used to have some hearts but sold them a while back or you could have those :(

hopefully shell get in touch soon??and help you out... its a shame :kiss:
